Separation and divorce involve different legal stages for married couples in Ontario. Separation can trigger decisions about parenting, support, and property while the marriage remains intact. Divorce formally ends the marriage through a court order and can affect financial timelines.

Toronto, Canada, October 26, 2026 /NewsNetwork/ -- Ontario couples experiencing the breakdown of a marriage often face legal and financial questions before a divorce is finalized. Although separation and divorce are closely related, they have different effects on marital status, property division, parenting arrangements, and financial obligations.
Separation generally occurs when spouses end their relationship and begin living separate lives. They do not need a court order to become separated.
In some circumstances, spouses can also be considered separated while continuing to live in the same residence. The nature of their relationship, rather than simply whether they occupy different homes, can be relevant to determining when separation occurred.
Divorce is a separate legal process.
Under Canada's Divorce Act, a divorce must be granted by a court. Separated spouses remain legally married until the divorce takes effect.
The most common basis for divorce is living separate and apart for at least one year. The Divorce Act also recognizes adultery and physical or mental cruelty as grounds for establishing marriage breakdown.
The distinction between separation and divorce matters because spouses may need to address significant family law issues before the marriage legally ends.
Parenting arrangements can be established during separation. Parents may need to determine how parenting time will be shared, who will make important decisions for the children, and how expenses will be managed.
Child support and spousal support may also become relevant during separation. Depending on the circumstances, support can be addressed through an agreement or court proceedings without waiting for a final divorce order.
Property division creates another important distinction.
For married spouses in Ontario, the separation date may establish the valuation date used to calculate net family property. The calculation generally considers assets and liabilities at relevant dates to determine whether an equalization payment is required.
The timing of divorce may also affect property claims. Under Ontario's Family Law Act, applications for equalization are generally subject to limitation periods, including two years after divorce becomes final and six years after separation where there is no reasonable prospect of reconciliation, subject to the applicable statutory rules.
A divorce therefore should not be assumed to resolve every outstanding financial matter.
Separation agreements can help spouses establish arrangements for parenting, support, property, and other matters. Under Ontario law, domestic contracts must meet specified formal requirements, including being in writing, signed by the parties, and witnessed.
A separation agreement does not itself end the marriage.
Separated spouses may also need to review wills, powers of attorney, beneficiary designations, and other financial arrangements because separation and divorce can have different consequences for estate planning and related rights.
Common-law couples face a different legal framework. They do not require a divorce when their relationship ends, and Ontario's property equalization system for married spouses does not automatically apply to them.
Understanding these distinctions can help Ontario couples identify which issues need attention during separation and which require a formal divorce process.

South Korea earned US$116.63 billion more from the world than it spent in the second quarter of this year – exceeding the combined current account surpluses of Germany and Japan for the first time on record. The current account measures a country’s trade and income with the world. It counts goods and services sold abroad, money earned on overseas investments and payments flowing the other way. A surplus means more foreign currency is coming in than going out. Surging demand for semiconductors...
For decades, China was one of the world’s largest sources of migrant labour. Its workers staffed factories at home and built infrastructure abroad. But demographic decline may eventually force China to contemplate a striking reversal: importing workers on a meaningful scale. That change is not imminent. China still has a vast labour force and substantial youth unemployment. It is investing heavily in industrial automation, extending working lives through a gradual increase in the retirement age,...
