A truck crash claim rarely involves just one insurer. A León Law Firm guide explains who can be liable after a Texas 18-wheeler crash and why the $750,000 federal insurance minimum is only a floor.
Sugar Land, United States, October 26, 2026 /NewsNetwork/ -- After a crash with an 18-wheeler, injured Texans often find themselves dealing with more than one insurance company. A guide from The León Law Firm, P.C. explains why truck crash claims often involve multiple liable parties, multiple policies, and a tougher fight over who pays. The guide is available at https://theleonlawfirm.com/who-is-liable-in-a-truck-accident/
The stakes on Texas roads are high. According to the Texas Department of Transportation’s 2025 Texas Motor Vehicle Traffic Crash Facts report, 3,769 people died and 244,534 were injured in Texas traffic crashes in 2025. When a large truck is involved, the size difference alone raises the danger. A loaded 18-wheeler can weigh up to 80,000 pounds, compared with roughly 3,500 to 4,500 pounds for a typical passenger car.
A car crash usually involves two drivers and two insurers. A truck crash rarely stays that simple. The driver, the trucking company, the owner of the truck or trailer, a maintenance contractor, the company that loaded the cargo and even a parts manufacturer can each share responsibility. In some cases, a government agency responsible for road conditions is involved, which brings its own strict notice deadlines.
The trucking company is usually the main defendant. Under a long-standing Texas rule known as respondeat superior, a carrier is generally responsible when its driver causes a crash while on the job. Carriers can also be liable for their own mistakes, such as hiring a driver with a poor safety record, failing to train or supervise drivers or pressuring them to break federal hours-of-service limits.
Insurance matters most in these layers. Federal rules under 49 CFR § 387.9 require most interstate freight carriers to carry at least $750,000 in liability coverage. The guide stresses that this figure is a floor, not a ceiling. Many carriers carry more, and umbrella or excess policies are common. Each additional liable party typically brings its own policy, which can increase the total coverage available for medical bills, lost income and other losses.
More insurers can also mean more resistance. The guide notes that trucking insurers often move quickly after a crash, sending adjusters, requesting recorded statements, or making early offers before the full liability picture is clear. Fault still matters. Under Chapter 33 of the Texas Civil Practice and Remedies Code, an injured person’s recovery is reduced by their share of fault and barred only if that share is more than 50 percent.
In the guide, founding attorney Carlos A. León emphasizes preserving evidence early. Electronic logging device data, maintenance records, driver qualification files and the truck’s event data recorder can show who was responsible. Still, federal rules require carriers to keep some of those records for only six months.
